Who can access infomation? AckeeHead is not required to disclose some info to the public. Upon request, however, AckeeHead can disclose the register to: Shareholders and creditors, who must provide an affidavit stating that the information obtained will be used only for matters related to AckeeHead. Certificate of incorporation 8 (1) Subject to subsection (2), on receipt of articles of incorporation, the Director shall issue a certificate of incorporation in accordance with section 262. Marginal note:Exception — failure to comply with Act (2) The Director may refuse to issue the certificate if a notice that is required to be sent under subsection 19(2) or 106(1) indicates that the corporation, if it came into existence, would not be in compliance with this Act. Approval of financial statement 108 The financial statement shall be approved by the board of directors, such approval to be evidenced by the signature at the foot of the balance sheet by two of the directors duly authorized to sign, and the auditor’s report shall be attached to the financial statement or there shall be inserted at the foot of the balance sheet a reference to the report. Mailing of financial statement to shareholders 109 (1) A public company shall, ten days or more before the date of the annual meeting, send to each shareholder at the shareholder’s last address as shown on the books of the company a copy of the financial statement and a copy of the auditor’s report. Financial statement, private companies (2) A shareholder of a private company is entitled to be furnished by the company on demand with a copy of the documents mentioned in subsection (1).
